On May 15, 2008, the Supreme Court of California overturned the state's ban on same-sex marriage. Then in November the people (**Please make a note: THE PEOPLE) voted to define marriage between a man and a woman (Proposition 8). Yet they are still debating this Issue?
Protesters lined up in front of the Supreme Court of California in hopes that the judge will overturn the choice made by the people.
The courts have NO right to overturn something that the people as a majority voted on. If they are able to then what is the point of voting. Isn't it to have our voice heard? I don't feel that it's within their judicial power to overturn a vote of the people. Kate Kendell (Executive Director, National Coalition of Lesbian Rights) said: "...if the Court upholds Prop 8, what they are essentially saying is the Court has no role in deciding equal protection issues because the majority vote trumps the Court’s role as protecting Constitutional rights."
Well yeah! the majority vote trumps the court's. That is WHY we vote. That is why California put it to a vote. To hear the voice of the people. No, I say if the courts uphold Prop 8 then what they are saying is that the people's voice is important and it counts!
Remember what Kate Kendell said above:..."the majority vote trumps the Court's role as protecting Constitutional rights." Okay now bear with me, for this is the key - "evil can be twisted into virtue if you phrase it just right. Any vice is acceptable if you cloak it as an issue of freedom. Any immorality is worth fighting for if you tell them they are fighting for choice, if you wrap it in the mantle of privacy and freedom" ~Chris Stewart.
And that my readers is exactly what Kate Kendell and others like her are doing.

Very interesting. I think most groups not just gays and lesbians (all though you hear from them more) will try and fight for their cause or lifestyle against all odds. And you know I am okay with that to a point. You can't have the people vote on it and say what happens happens and then when you don't get the vote you want you through a pity party and want the courts to change it. Man that was a huge run on sentance, but so are legal sentances so I'm good.
You don't want me to go off on what I feel about gay marriage. It is wrong and though I have been told and explained by many of my friends that are gay, I feel they can control the urge of the opposite sex but in their past had some mishap that caused them to shun a healthy relationship. Give it up the people have spoken go hide under a rock.
this is one that burns me up! i got into w/ someone on facebook last week about this. her and her friends were bashing the church, calling us all horrible names saying we are ignorant and prejudice and that we hate the gays because it's not cool to hate the blacks! i guess for them they hate the mormons because it's not cool to hate the blacks! who's ignorant and prejudice?!
it made me mad. so i commented to her (she is not one of my "friends" by the way!)
she was complaining that the church raised more $ than anyone to fight prop 8 blah,blah, blah. from my understanding the church as an organization raised none but members did. then i got to thinking-who cares! even if they did it's their right. just as it's her right to fight for her side and raise money if she chooses. further more, if they did raise so much $ wouldn't that mean that people support what they are raising it for.
and just as you said...the people voted! the people of california had their say-"you" just don't like what they said!
i don't like that the majority of the country voted obama in. does that mean i get to storm the white house as they did to our temples? does that mean i get to threaten the democratic party? or find a court to overthrough it?
No. there was a vote-i lost i just have to deal with it. find a way to change it-legally and ethically! then when i mentioned my rights being violated by prop. 8she threw up her hand (figuratively). she didn't want to hear about that. so what?-i'm straight so i don't have rights?! that doesn't make any sense!

i should send you something that my mom forwarded to me. they want to teach homosexual relationships in the ct schools and along with that they want to teach that anyone who believes that those relationships are wrong has a disorder-they even put a name on it -which i can't remember right now. it makes me ILL!
i realized that i twisted things in my comments on prop. 8. i always do that. i know what i stand for but is it a yes vote or a no vote!? anyway, i am for marraige between a man and a woman which means i think i would have voted yes-if i could have voted on it.
i can be an idiot.
